Discover Credit card department,
I am getting ready to retain an attorney so that I can take legal action against Discover Financial Services. Dealing with this company has been nothing short of a nightmare, but I 'm going to give them - final chance to resolve this matter to my satisfaction. That is what I 'm hoping to accomplish with the help of the Consumer Financial Protection Bureau. If Discover Financial Services is still unwilling to help me, I will contact my legal counsel to file the lawsuit. In -, Discover Financial Services became aware that I was disputing the account ending in -. However, they did not notify the credit bureaus until - of -. The Fair Debt Collection Practices Act, specifically FDCPA 807 ( 8 ), mandates that banks, credit card companies, and collection agencies have 30 days to contact the credit bureaus when they become aware negative information is being disputed. This makes Discover Financial Services liable to me for damages of up to $1000.00. I have detailed records, including USPS receipts, showing that Discover Financial Services missed the 30 day deadline. On top of that, before I paid off the account, they sent it to an unscrupulous collection agency. This collection agency illegally revealed my debt to multiple third parties in recorded messages. These are very serious violations, and unfortunately for Discover, I still have those recordings. I will therefore be seeking an additional $5000.00 in punitive damages.
