NEEDS IMMEDIATE CONSIDERATION - SHERIFF SALE SET FOR - -, -/-/-I have lived in my home with my children since -. I got behind because of a number of financial, emotional and healthcare needs of family members in -. I started working with PHH Mortgage when I got behind in order to make payment arrangements to get myself current. ( I had gotten behind - before with my prior servicer, - and they were very helpful in working with me so I expected my process with PHH to go as smoothly. It has not. ) I have been in the revolving door of paperwork submissions, including paperwork that I have sent that they continued to say was not good enough. For instance, the lender wanted proof of child support. I provided transaction histories, deposits onto a debit card and a court order, and still the lender would not accept this proof as sufficient. I 'm not sure what else I could offer to prove I am receiving this support. They have asked me more than - for a divorce decree, and they would not accept my tax submissions because they said I needed to have my husband 's signatures and


I 'd submitted a full and complete financial application packet to them and gotten confirmation that the packet was complete, my - - asked for a signed and completed - - '' but no such form was included in the - page packet. My housing counselor called. They emailed a missing document letter along with - forms to complete. They wanted the UBAF but we 'd sent the RMA. They also provided a financial form. We completed and returned it. The housing counselor spoke to them on - ( yesterday ) and they said I was denied due to missing documents. They claim I was missing the HUD Hardship Affidavit Form '' but when the housing counselor asked them to provide a copy of the form since she had no idea what they meant, they sent her to : www.iowahelpforhomeowners.com b/c the 'rules ' do n't allow them to send out forms. She finally spoke to a supervisor, who provided the old HAMP hardship form from - via email, but said they are unwilling to review her file and scheduled a sale for -. My denial letter was supposedly sent out yesterday. Finally, all of the requested blank forms were sent to my housing counselor via email on -/-/- from a supervisor, but this gives me so little time to reply because my house is already scheduled for sale in 3 weeks! The lender said they tried to reach me, but when I would get a phone call from them, I would answer and would get put into an automated system on hold, and when someone would come on, they would verify that I was the homeowner, but then would put me back on hold and no one would come back to the line after many many minutes of waiting, and then the line would go dead. Or they would call and say This is an attempt to collect a debt '' and someone would tell me my house is in foreclosure and ask how I can make a payment! This feels like a conspiracy, not an effort to work with me to make the mortgage payments I am prepared to make with my wages and my child support. I 've even gotten a - job that I am going to start in -, increasing my income. I want to keep my house and pay my debt but the lender keeps choosing to make it impossible to work anything out with me and is violating the CFPB regulations for loss mitigation servicing.
