My client is in severe distress with her current property. The servicing company is BSI Financial ( The Servicer ) and the investor is - ( The Investor ). The problem all arises out of the investor not having to comply with any of the federal laws that were enacted to protect consumers from predatory loans and banks. Through my office my client has tried to receive - loan modifications and was denied both times for arbitrary reason. I my experience my client has the income to support a modification and her hard ship fully supported being granted a modification of her ARM loan that should have never been given to her in the first place. While in the process of obtaining a loan modification my client has been forced to file - chapter - bankruptcies to prevent foreclosure auctions. The investor has never made an honest attempt to modify this loan and has conveyed to my office that they do not have to play by the rules because they never received BAIL OUT MONEY. My client is a single mother who has custody of her grandchildren and has a - child of her own. She originally fell behind when
a modification my client is ready to throw in the towel. My client hired a real estate agent to sell her home and try to regain some of the equity that she has in her home. Her home was on the market for - months without a single offer that would allow her to regain some of the equity she may have in the home. My client did however receive an offer for $250000.00 my office submitted this offer to BSI for review. BSI never conducted any sort of valuation on the property and simply conveyed to us that the Investor denied the short sale and wants a full payoff, no counter offer was given nor was the full payoff amount given. My office has since requested - payoffs from BSI so that we can try to get our client as much as possible for her home. BSI has yet to supply us with a payoff which is continuing to delay the sale process, and when we ask when we will get the payoff BSI states that they are having internal problems calculating the ARM payoff. This is the most problematic file within our office. The property taxes are also unpaid for the years -/-/- and -/-/- to date. The tax issues just show that the investor has no interest in doing anything on this property and has no regard for my client who has lived in this home most of her life. My client needs some sort of help/ leniency from the Investor. We have worked with BSI many times before and have found them to be - of the better servicers for short sales and Modifications, this is what leads us to believe that the issues are directly related to the investor.
