I had payment agreement with a medical provider to pay bill at $25.00 every other week which I started immediately. Provider then sent account to collection in spite of agreement and then stated they are no longer collecting the item. I have attached several docs showing that I made a $25.00 payment and then a bill after that from the medical provider showing they transferred the account to collection company as a bad debt write off in the amount of $750.00 despite the fact that I was making payments as agreed. The collection company, Consumer Collections Management Inc. then sent me a letter stating they are collecting the debt and the amount went up $150.00 for a collection fee, of which they can not validate that I EVER agreed to this with the original provider. This is a clear FDCPA violation. Also, they sent me the letter saying I had 30 days to dispute the collection in -/-/- ( also document attached ) to which I responded in writing by certified mail right away and far before the alloted 30 days. ( I have attached the proof ), however they reported it on credit immediately and despite my letter, ignoring
to send the validation that they can charge a collection fee or I they were in violation of FDCPA, I was transfered to the supervisor who refused to give her name and then she said she would send something in writing but the collection charges still stand and then hung up on me claiming I was being rude, which I was not and have a recorded call to prove it. This company is clearly operating by collecting debts using illegal tactics and ploys all while charging illegal fees for collecting debts without the legal ability or agreement by consumer to pay the fees with orginal creditor/provider. Luckily, I know my rights. I have sent payment to the medical provider for the $750.00 dollars to satisfy the debt in full. I do NOT owe the collection company and insist that they remove the collection immediately from my credit and NEVER contact me again. Please help enforce this and advocate my rights and protect and honest consumer or I will hire and pursue legal relief and remedy to the fullest extent of the law.
