I am writing to assert a formal Complaint against American Express and -. I have spent hours attempting to obtain a refund from - 's and American Express for a defective pet hair dryer. Clearly, - 's practices violates the mandates of the CFPB, State law and federal law. Moreover, American Express refuses to eliminate this charge from my credit card balance and simply sends form letters with no value or substance, other than issuing a partial credit. Specifically, American Express has refused to honor their warranty provisions of their credit card Agreement in connection with my purchase of a - - -. First, the - - - was supposed to provide some level of warmth to the air it emits. In fact, according to ( the manufacturer 's ) marketing material on the -, they represent : Great - for small and large dogs - speeds, - temperatures 1. - TEMPERATURES In the case of the subject -, there were not - temperatures. There was - and it was room temperature, even after - hour of operation, which was more than adequate for the unit 's motor to generate heat. Second, while safety of the pet is of paramount


2. - The - was represented to be a " - '' in the advertising materials, meaning that a " - '' generates blown air and velocity and a " - '' does just that .... it dries. However, since the subject - was defective and would not warm to any level beyond room temperature, it would not function as a " -, '' as represented. This was a material misrepresentation under UCC Section 2-315, the Uniform Consumer Credit Code and applicable State and Federal law. 3. SIZE OF THE DOG AND SIZE OF THE - In Groomer 's and - - - 's marketing materials, the unit was supposed to be a " great - for " small and large dogs. '' The dogs on whom the unit was used were small to medium sized, - at - pounds and - at - pounds. Neither have long hair. This unit would have been ineffective on the smallest of dogs. RETURN POLICY : - 's has referenced a " return '' policy. This policy presupposes that they did not sell a defective product. - 's Mall did sell a defective product and relying upon a self-serving return policy will not exonerate - 's Mall or - - - from violating federal or state law. It is my expectation that I receive a full and immediate credit on my American Express within 5 days of the date of this complaint. In addition, I recommend that the CFPB further investigate - 's practices based upon their false advertising and illegal business practices.
