We are a small home owners association. We have a unit in which the owner has passed away. The family has also walked away due to the large amount of mortgage that was owed and the HOA fees. The Bank that the mortgage was obtained from is having nothing to do with this property. As a result we are in legal limbo. No one is paying the monthly HOA fees, no one is keeping up the property or even trying to sell it to recoup some money. In fact, the bank is forcing the HOA to sue them to collect the fees or do something with this property. This has caused financial hardship to the other owners and the HOA as we rely on the monthly fees for daily workings of the condo complex. In addition, we have had to spend extra money for lawyer fees in an attempt to recoup costs.
