I am wanting to submit a arbitration claim against Equifax for FCRA and Maryland state deceptive trade practices violations. Their arbitration clause states as follows : " Binding Arbitration. Either You or Equifax may, without the other 's consent, elect mandatory, binding arbitration of any Claim ( as defined below ) raised by either You or Equifax against the other. As used in this arbitration provision, the term " Claim '' or " Claims '' means any claim, dispute, or controversy between You and Us regarding any aspect of Your relationship with Equifax , including but not limited to any Claim arising from these Terms of Use or arising from Your use of the Products or this Site or any information You receive from Us, whether based on contract, statute, common law, regulation, ordinance, tort, or any other legal or equitable theory regardless of what remedy is sought '' Their clause also states : ". The party filing a Claim in arbitration must select either the - ( " - '' ) or the - - - ( " - '' ) to administer the arbitration. " As I am sure you are aware, NAF does not perform consumer arbitration
lawsuits against them, yet a consumer is unable to initiate an arbitration claim against Equifax due to the - forums listed in their clause not accepting any cases with Equifax. What is a consumer to do? A consumer could initiate an action in federal court to compel Equifax to arbitrate, but until Equifax updates their clause to meet - 's consumer protocols, the consumer is pretty much in limbo. I am requesting your agency look into this illegal clause as I feel it violates not only the Federal Arbitration Act ( FAA ), but also Maryland 's deceptive trade practoces act. Thank you.
