Kings Credit Services was paid in - of this year for an old debt ( originating around 2010 ) earlier this year that was listed on my credit report as a result of a stipulation for qualifying for a loan to purchase a home for my family. In - they served me and my spouse with a summons that they are suing us for additional old debt they found after they received the a check for the original listed debt. This collection agency never contacted us regarding any debt owed to them, nor attempted to collect it. The old debt was discovered by my lender on my credit report. Since paying them the collection agency has since filed a suit against me and my wife to collect additional old debt, ( approx : $2500.00 in old medical services ), and in - of this year listed the additional old debt from 2010 with credit reporting agencies, resulting in negative affects with our credit score. My question is if California has a statute of limitations on debt collection related to actions a creditor can take, how are they able to sue a time barred debt, and is n't that against the law? Not only that, the documents related to the medical services they sent me do n't match the amounts listed on the court summons for which they are suing me for.
