The debt collector, Grant & Weber, refuses to prove that the debt is still valid and enforceable by failing to provide a copy of the signed contract. The difference between the debt being valid and expired depends on the existence of a signed written contract. Regardless, consumer has attempted to resolve the unpaid medical bill but collector is charging interest in violation of the FDCPA as they have failed to provide any evidence that they can collect interest. Further, debt collector states that medical provider will not negotiate a settlement which is a bold faced lie. They refuse to engage in negotiations and refuse to waive interest charges, yet the continue to report this account on the consumers credit report every month as an unpaid debt. The debt is nearly 6 years old. Their conduct is unfair, deceptive, and the practice of charging interest without a contract or law suit is a systemic and intentional violation of the FDCPA.
