Credit card protection / Debt protection California

I applied for a Barclaycard - credit card and they sent the card to the wrong address. The card was never activated, yet they charged me fees and late fees. I have made - phone calls to barclaycard to clear this up, yet it still appears join my credit report. I have ordered a new card and corrected the address. I have never been charged for fees from a credit card that was never activated. Is this legal?
