A little more than a year ago I refinanced my mortgage with my original mortgage company. Since the refinance the company has sent me my statement late. This past month statement, I received in the mail -/-/- and it was due the next day on -/-/-. I have contacted them many times and have been told that " they aren't responible for how slow the mail is '', or " my statement is always available online '', or " i don't need the payment coupon to send in my statement ''. The last excuse is that " the statements are a coutesy. '' All these excuses may sound resonable except I dont always have internet access, I have a legal right to receive a " hard copy '' billing statement in the mail ( not just a coutesy ), I also should point out that 12 C.F.R. 1026.41 ( b ), which requires a mortgage lender to deliver or mail a periodic statement within a reasonably prompt time after the payment due date or the end of any courtesy or grace period provided for the previous billing cycle. Receiving the billing statement 1 day before the due date is certainly NOT a reasonable amount of time since I choose to receive my notice by mail. I'm " old school '' and track my billing and spending and payments made through physical statements. With all the hacking and breeches these days I rely on the mailed copies. I need assistance in making this mortage company to understand my legal right in how and when I am to receive a proper statement by mail.
