The current issue just came to my attention when I attempted to get a loan and was asked about a charge-off listed on my account. I should not have had any charge-offs so after requesting my credit report I found that CNAC had reported this to the credit agency. CNAC was the holder of a car loan that was sold to another company who filed a civil suit. This went to mediation and the case was dismissed due to the alleged debt being the direct result of an illegal repossession and illegal communication of this debt according to GA law. The company did not sent proper notification under GA law. The illegal repossession and communications were done by CNAC at the time they first attempted to collect this alleged debt. These actions lead to the dismissal of the debt and was filed with the court. It has now come to my attention that CNAC is reporting this as a charge-off on my account when the debt was dismissed due to it being an illegal repossession and improper communication of debt. CNAC would not accept me telling them via a phone call this case had been settled and refused to acknowledge that this debt had been dismissed. This debt is an invalid debt and was proven as such in the civil case regarding this alleged debt. This is negatively impacting my credit and has contributed to me not being able to obtain credit on several occasions.
