I - - believe that under the modified Fair Debt Collection Practices Act that I should have all aspects of foreclosure ceased against my home until I can package all documents necessary for a mortgage modification. When my wife went through a -, she had to leave her work that paid more than $30000.00 per year. I had to take an extended leave of absence from my job, but I am fully employed again. In - of - I was involved on a conference call with the representatives of Wells Fargo Bank, -, - - -, - and the clerk of the court. During that discussion, I was given until - -, - to present all my documents to -, - - - -. I will have a complete modification package within the next week, and it looks like my wife will be able to start work -/-/-. On - -, -, the law firm filed a Notice of Motion proposing the granting of Summary Judgment on my case. I am burdened with a great deal of medical debts as well as additional debts I defaulted on while my wife was sick. I intended to obtain a mortgage modification, then file a bankruptcy petition Chapter - to alleviate all debts outside of the bankruptcy. I can not deal with the excessive pressure presented against me now. I need all foreclosure actions to cease under my rights with the Fair Debt Collection Practices Act mandate of - -, - until a resolution on a modification can be accomplished.
