I was renting a living space from an out of state landlord. I live in Florida and the landlord lives in Minnesota.I mailed a rent check to my landlord in - of -. The land lord called me and asked me to pay the rent to another bank that held his mortgage because this bank had no branches in his state and he did not want a late fee. He told me he would destroy the check I sent and we made the arrangement for me to pay my rent directly to his bank that held the mortgage to the rental property. Fast forward to - - I gave notice I was moving and paid my last months rent. After I moved out he cashed the Check that he was supposed to have destroyed. My banks policy is that checks expired at the 6 month mark, and even though this check was 14 months old they payed out on the check, over drafting my account which they are not supposed to do because I refused overdraft protection. I filed a complaint with my bank and they said even though they were in the wrong they would not refund my money. I am on - and live month to month on my check
