I deposited a - - - check into my Bank of the West checking account on - -. I deposited the check so my Bank of the West mortgage would be paid on - -. The funds were in - - -, but because this was a mobile deposit made with an -, Bank of the West did not credit the deposit until - -. I did not learn of the delay until - -, and never even considered the possibility of such a long delay because all previous delays for mobile deposits had been around 3 days. So, my mortgage payment was late and Bank of the West charged me a $35.00 " insufficient funds '' fee. When I called to complain Bank of the West reversed the $35.00 fee, but the late payment to my mortgage is still recorded. Bank of the West told me that with mobile deposits they have the right to delay the funds for up to 10 days. That time period is wildly unreasonable. The longest lawful delay I could find for deposit times listed on the Federal Reserve website was 5 days. A ten day delay is outrageous, it is a loophole in the law and the CFPB really needs to work to see that this scam is outlawed. Please! My primary bank is - - - and I only use the Bank of the West account for my mortgage payment. I believe Bank of the West is trying to push me into using more of their services, such as overdraft protection, by delaying as long as possible my funds transfers from - - -.
