Synchrony Financial Credit card department,
My BP credit card account changed servicers to Synchrony Bank ( SB ) in -, -, and a series of problems began with SB overhanging, adding unnecessary fees, etc. SB refused to resolve any of the issues, so I quit paying on the account, in -, -. SB only continued to add extra fees and changes, pushing the account over the credit limit of $1000.00, which continued month after month. I complained that these tactics by SB were in violation of consumer protection laws, such as the Indiana Deceptive Consumer Sales ACT ( DCSA ) ; which carries a civil penalty of over $1000.00 per violation that a consumer can collect, plus legal fees and other costs, but was ignored. As I am over 60 years of age, the civil penalty under Indiana law is doubled. As there are numerous violations under the DCSA, the civil penalties that I could collect exceed any amount alleged to be owed SB.
I also had another account with SB that was full of errors and problems, as SB had filed a lawsuit against me which had robo-signing, fake affidavits, etc. that an attorney discovered. SB was forced in -/-/- to withdraw this lawsuit and judgment. SB still owes me money from that illegal lawsuit, which it has not paid. This unpaid amount would also more than offset the $1000.00 that SB alleges is owed on this current account. With all of these problems, SB last month sold the account to a third party debt buyer-- - -, - for pennies on the dollar without adequate notice. SB failed to inform this debt buyer that the amount of the account is in dispute, and that SB has civil penalties from this account and the other account that more than offset any amount alleged to be owed. I will now have the same account reported TWICE on my credit report, and the amount of the alleged debt will be wrong. Hence, I will have a violation of the FCRA that is the result of SB hurriedly trying to sell the account.
