- - - - - University Williams & Fudge Current Loan Service Provider ALL of my student loans federal and private were originally housed at -. In - I consolidated with - and called to close all the - accounts and was told they had all been paid and were closed nothing was mentioned that the private loan account was still open and only the federal had been closed. I did not receive ANY communication from the University or the service provider after graduation regarding this loan. When I inquired about this, -, stated that the only address on record was my college -. I learned that " certified mail '' can not be forwarded so it was returned to -. Being that - was my original service provider on ALL my student loans, I only found out about this loan not being consolidated with the others when I pulled my credit in - -. Williams & Fudge acquired the account in - of -. I was never called or pursued by WILLIAMS & FUDGE. When I found the collection on my credit report I called the telephone number provided and spoke to Williams & Fudge. I was originally told
if I made payments and rehabbed the loan. I contacted - - and - - to verify the debt and to inquire why this loan was listed in default. Both verified the amounts owed so I started making payments to W & F starting in - - and have monthly since that time. In -, my accountant reviewed the account history provided and noticed a " reverse payment charge ''. I inquired with W & F, - & - and no one could provide any information as to what the charge was. W & F and - stopped returning and taking my calls or emails. In - I spoke to - - at - who said the charge was probably back interest so I dropped the inquiry. In - Of - W & F upgraded to a new system and Listed the former reverse payment as a collection charge. After further research and legal counsel, I am requesting that the Collection Charges be removed from My WILLIAMS & FUDGE account. It is rather frustrating being that I was originally told by - - at WILLIAMS & FUDGE that I was not being charged a collection fee on the account, So due to that deceit, I have paid interest that could have been avoided. Only the past due and late fees we being assessed. The promissory notes are lacking in many areas as stated by -. I have also since found out that MHU can no longer provide me with any information per the contact they have with W & F My promissory notes only come close to saying anything about fees as incurred ... ... had MHU placed a lawsuit/judgment against me ( which obviously did not occur and by the time the loan went to WILLIAMS & FUDGE the NC SOL had expired. Below is the text I am referring that is connected to the clause stating that if the lender calls the full balance to be paid immediately which did not happen : Payment of lenders costs and expenses if the lender has required me to pay in full as described above the lender will have the right to be paid back by me for all of its costs and expenses in enforcing this note to the extent not prohibited by applicable law those expenses for example include reasonable attorney 's fees. NO judgement was ever filed so this clause does not apply.
