Upon vacating a previous apartment complex the landlord had claimed damages to their carpet which we immediately disputed. The apartment complex did not provide an itemized list of damages as requested by tenant and within the 30 days as required per the lease and Massachusetts state law. National Credit Systems, who had then become the debt collector contacted us in regards to the disputed debt. We immediately told them the debt was in dispute. They claimed they would verify the debt and get back to us. Shortly after National Credit Systems stated the debt was valid and provided proof of the damaged carpet with a photo copy of a pay stub of the former tenant. A pay stub to prove that the tenant was in debt in regards to damaged carpet? This sequence of events is in violation of 15 U.S.C.1601 Fair Debt Collections Practice Act. This by far does not come close to validation of debt even after requesting validation by the accused debt holder.
