Quality Loan Service Corporation - has no record of bankruptcy stay and or proceedings from - or - QLS received information after complaint filed - -which raised more questions QLS - email provided in - makes no mention of bankruptcy stay, notices or correspondence to or from any bankruptcy proceedings ( attorney etc ) QLS has not provided any documents correspondence with - or - - stating to proceed with foreclosure - was out of business in - according to SEC noticed I received - the request would have had to come form - After QLS response raised more questions and research The Notary - - has confirmed only the Recession document to be valid-no notary negligence The Trustee Deed Upon Sale as not being valid-notary obligation not meet-notary negligence QLS - stated below in email someone instructed them to foreclose while I was in bankruptcy stay- Who? and what date? and where is the letter?
It disappointing when a homeowner in trust agencies and people when signing the agreement. The trustee is to be neutral for all parties involved. QLS has stated very personal comments instead of assisting to correct its errors, and mistakes. - -, Quality was the trustee and therefore does not now and has never been in possession of your original Deed of Trust or Promissory Note. We do have a copy of the Deed of Trust, which I have attached for your review. As you can see, the original beneficiary of your Deed of Trust was - - Bank, -. I have also attached a copy of the Assignment of Deed of Trust, by which - - assigned your Deed of Trust to - Bank - as trustee for - Mortgage Pass-Through Certificates Series - Trust. The assignment was done on - -, -. Also on - -, -, - Bank - as trustee for - Mortgage Pass-Through Certificates Series - Trust substituted Quality as trustee, as indicated by the attached Substitution of Trustee. Quality processed the foreclosure and held a sale on - -, - and the property reverted to the beneficiary, - Bank - as trustee for - Mortgage Pass-Through Certificates Series - Trust. However, Quality was thereafter instructed by the beneficiary to rescind that sale, so it recorded a Notice of Rescission of Trustee 's Deed Upon Sale on - -, -. Both of these documents are attached for your review. Quality thereafter was instructed to re-notice the sale and proceed with the foreclosure, which it did on - -, -. By that time, - - -, NA had merged with -, which is why the Trustee 's Deed states that the property was conveyed to - - -, - - as successor by merger to - as trustee for - -. I have reviewed your foreclosure file and do not see any defects in the foreclosure process. Although Quality does not maintain a copy of the Note in its file, I acquired a copy of your Note from the lender, which I have attached for your review. My - Number is -.
