Payday loan Taking/threatening an illegal action Sued w/o proper notification of suit California
In -/-/-, I was forced into a position where I needed a loan from - to make a deposit on a place to live. In -/-/-, I lossed my job and could no longer make payments toward this loan. At this time, I had already paid back the loan amount, but was still being charged interest. My loan was charged off in -/-/-. Collection efforts stopped and I was informed that my loan was null and void since - was being sued for illegal online loan servicing. This loan was also removed from my credit report. On -/-/-, I was notified by my Financial Institution that a levy had been placed on my bank accounts. I contacted the firm listed on the levy and was told that they were attempting to collect for this - - loan. I was NEVER notified in any way that an attempt to collect the debt was still in place. I DID NOT receive a summons to appear in court and lost the right to defend myself.
false and inaccurate information. The servicer lied and stated that I was served by personal service at my former employer AFTER I had lost my job. I have since filed a request for dismissal with the court for this judgement against me. Additionally, the loan was charged off in -/-/- and the Statute of Limitations to collect on this debt has expired. I have also filed a Claim of Exemption for the bank levy since the deposit accounts held are my only source of income and neccessary for my basic needs. This law firm has no legal right to collect this debt and filed false court documents to get a judgement that I was never even aware of.
