Non-federal student loan Taking/threatening an illegal action Threatened to sue on too old debt New York
I was sent a summons from the law office. I answered the summons -/-/2014 with the county clerks office in my area. the law office stated I never answered the summons and had a judgement won against me.I had the judgement appealed because I did answer the judgement. This debt is not a federally backed/guaranteed loan. It is being reported to the credit bureaus beyond 7 years. Also it is beyond NY statute of limitations ( 6 years ) to collect a debt. I Have never made a single payment to this debt in its history. ( A Summary of Your Rights Under the Fair Credit Reporting Act ) Consumer reporting agencies may not report outdated negative information. In mostcases, a consumer reporting agency may not report negative information that is more thanseven years old, or bankruptcies that are more than 10 years old.
