Gurstel Chargo has committed numerous FDCPA violations related to a dunning letter sent to consumer dated - -, 2015. In the letterhead of the 'dunning ' letter Gurstel Chargo claims to have offices located in Nebraska . Checking with the Secretary of State 's Office, no licensed collection agency by that name exists. Furthermore, the letterhead represents Attorneys at Law but has a 'disclaimer ' in the body of the letter that states : At this time, no attorney with this law firm has personally reviewed the particular circumstances of your account. '' - If an agency incorporates the use of form collection demands on attorney letterhead the agency MUST incorporate meaningful attorney involvement '', into its collection process. 15 U.S.C. Section 1692e. These are just a few violations regarding a dunning letter sent to consumer dated - -, 2015. Consumer will file a federal and state lawsuit against Gurstel Chargo for violations of the FDCPA, FCRA and TCPA if Gurstel
payment history, nor products, or services that have been rendered to Gurstel Chargo, because these elements do not exist ; there is a failure of consideration and no valid agreement, contract or fiduciary obligation under federal law that requires payment to third-party debt collectors. Consumer 's sole income is Social Security - income which is federally protected income under Section 207 [ 42 U.S.C. 407 ] ( a ) of the Social Security Act ; ( SSA ). Consumer is head-of -household and possesses no property of value. Consumer 's federally protected income presents a 'genuine issue of material fact ', that will result in a frivolous lawsuit if pursued. Consumer filed this complaint as a means of formal documentation that consumer will 'tender ' as evidence in a court proceeding if Gurstel Chargo pursues this matter.
