This complaint is being submitted by - - - ( - ) on behalf of - and - -. This complaint pertains to Rushmore 's violation of the CFPB 's loss mitigation procedures. On - -, 2015, - faxed a complete Request for Mortgage Assistance ( RMA ) to Rushmore 's Home Retention Department on behalf of - and - -. ( Exhibit A ). Pursuant to Regulation - of the Real Estate Settlement Procedures Act ( RESPA ), a servicer must Notify the borrower in writing within 5 days ( excluding legal public holidays, Saturdays, and Sundays ) after receiving the loss mitigation application that the servicer acknowledges receipt of the loss mitigation application and that the servicer has determined that the loss mitigation application is either complete or incomplete. '' - ( B ). To this date, - -, 2015, Rushmore has not acknowledged receipt of the - ' application.
