I have never received any notice of default from collection agency Simon 's Agency. I have discovered the collection activity while reviewing my credit report in late -/-/-, and I have sent a notice to Simon 's Agency ( a debt collector who does n't own but is assigned to collect the debt on behalf of - - - ) on -/-/-. A subsequent follow up complaint was sent to - via -. - is the current account owner and allegedly the original creditor. I have advised both them of dispute of the information submitted to Credit Bureaus. A notice sent to Simon 's Agency specifically stated that " this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. '' Neither Simon 's Agency nor - provided any viable evidence, copy of the signed contract or even copy of the statement to substantiate the claims made. Instead, both companies refer to internal printout of alleged payments made in -/-/--/-/- and admit that they have no other evidence to back up their claims. However, despite the lack of evidence to substantiate the claims both companies insist that the debt will be reported to credit bureaus as validated and refuse to resolve this matter.
