VA mortgage Settlement process and costs California

our lender ( Ditech Mortgage Corp ) did not pay our impounded property taxes as per the scheduled payment due. Now we are in default to the tax board with penalties. this came up today when trying to finalize a refinance loan. this issue is delaying the closing and will affect my rate. this needs to be resolved asap please.
