I have sent multiple letters asking for copies of proof of the legal notices and proof of the commercially reasonable manner of resale of a vehicle that American Credit Acceptance is claiming to be repossessed. The first letter was sent on - -, -. This letter was sent certified mail return receipt and I have proof of delivery. This letter was received by - - - -, -. This letter was asking for copies of proof of the legal notices and the commercially reasonable manner of resale of the vehicle in question. Under the laws of the State of Georgia UCC - and State - and - statutes a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. I asked American Credit Acceptance to provide proof within 14 days from the receipt of this notice or the claim of a deficiency will be considered null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation


There was no response from this letter. I then sent a follow up letter on - -, - reminding American Credit Acceptance that they have failed to respond to my letter to them in a timely manner, and requested that the remove their entry on my credit reports ( -, -, and - ) within the next 14 days of receiving my letter. I believe my request were reasonable and American Credit Acceptance has failed to respond in a timely manner. This is a fraudulent claim by American Credit Acceptance on my credit reports and American Credit Acceptance is now in violation of both the FDCPA and FCRA.
