I wish to request assistance from the Consumer Financial Protection Bureau with regard to ongoing violations of 15 USC 1692 - f ) ( 1 ) and 1692 ( c ) ( c ) of the Fair Debit Collections Practices Act ( " FDCPA '' ) ( 15 USC 1692 ) by Eastern Account System of Connecticut , Inc. ( " Eastern '' ). On - -, -, - - - ( " - '' ) produced an invoice in the amount of $140.00 for services purportedly performed on - -, -. This amount is considered an untimely billing request under Title 6, Chapter 146, 146.002 of the Texas - - and Remedies Code ( occurring both after the first day of the - month after services were performed ( 146.002 ( a ) ) as well as beyond the contractual date established between the medical service provider and the issuer of the health benefit plan ( - ( c ) ) ).


unlawful claims constitutes an " unfair practice '' as defined by 15 USC 1692 ( f ) and a violation of the Fair Debit Collection Practices Act. The unlawfulness of the claim in consideration was conveyed to - by certified mail ( copies attached ) on two separate occasions - - -, - ( USPS Tracking # - - - - - - ) and - - , - - USPS Tracking # - - - - - - ) as well as with numerous communications both written and verbal between the health benefit plan provider, -, and - during that time period. - had full and complete knowledge that their claims were barred from collection under the Texas Civil Practices and Remedies Code and made no attempt to correct their activities over multiple months of written and verbal correspondence. With such full and complete knowledge of an attempt to collect a claim not " permitted by law '' ( 15 USC 1692 ( f ) ( 1 ) ), Eastern 's collection letter of - -, - is evidence of the firm 's intentional violation of 15 USC 1692 ( f ) ( 1 ) and can be considered in no way a result of a - fide error or unintentional practice as defined by 15 USC 1692 ( k ). Furthermore, both the communications of - -, - and - -, - sent by certified mail provided notice in writing of a desire to have all communications applicable to this matter with any debt collector immediately cease as provided by 15 USC 1692 ( c ). Through such written requests, Eastern had been provided full and complete knowledge of a desire to cease all communications related to the unlawful attempt to pursue a claim prohibited by Texas Law. While fully aware of this request, communications were made on - -, - in violation of 15 USC 1692 ( c ) in no way a result of a bone fide error or unintentional practice as defined by 15 USC 1692 ( k ). I would therefore request the assistance of the Consumer Financial Protection Bureau in addressing numerous violations of the Fair Debt Collections Practices Act. I would be more than happy to assist in any ongoing investigative activity and administrative enforcement activities permitted - - USC 1692 ( l ) in obtaining civil liabilities as may be provided by 15 USC 1692 ( k ).
