Vehicle loan Problems when you are unable to pay Alabama
On or about - -, - I contacted - - at Summit Financial to verbally advise that I was voluntarily surrendering the - - -. - - stated that it was the holidays and that no one was available to pick the vehicle up. I advised - - I was able to take the vehicle back to - -, he told me that I was not able to do so. - - advised that a representative would contact me at the phone number provided to schedule a time to pick up the vehicle. I received no contact from said person, - - received a call on -/-/- from a woman calling from - stating that they were issuing an enforceable warrant for my arrest but did not say for what reason or why. I called on -/-/- at - - and spoke with an individual named - - - whom stated that she was from the enforceable warrant reporting/processing office. - - advised she saw in the notes that someone spoke with me stating I was voluntarily surrendering the vehicle but that they were headed to court this afternoon to place a warrant for my arrest for not surrendering the
to come get the vehicle as long as it was not in a gated community. I advised her that I was not comfortable with that, that I wanted to be there and receive something in writing stating that they have secured the vehicle. She stated that Summitt Financial is a large company and that I would receive something in the mail 10 days later stating that I could pay off the debt to retrieve the vehicle or advise me of the debt which was owed. I advised her that I was currently out of town but the vehicle was at the residence which was listed on contract. She stated that they had to obtain the key, I advised them to tow the vehicle. She threatened to have me arrested and a warrant issued. I advised her that what she was doing was against debt collection practices and that she had no right to tell anyone that a warrant was going to be issued nor should I be penalized nor threatened with a warrant because Summitt Financial failed to contact me to schedule a pick up time. I have the emails and I am able to obtain records of my phone log to prove that I have initiated contact with the company to secure the vehicle almost 30 days ago.
