We started the home buying process - 2015. The home we were buying was to close on - -, 2015. We had some trouble with VA underwriting and ended up closing on - -, 2015. My husband and I signed all closing docs on - -, 2015 at North American Title. Our sellers and agent picked the title company. We had never used them before. On page - of - of the residential purchase agreement the seller was to pay all HOA fees. We also asked for a home warranty up to $750.00. The sellers agreed and signed. The sellers were represented by - - -. Everything was signed and agreed upon before we signed the closing docs. On - - - our agent - - contacted us stating that the sellers/ relo company refused to pay the HOA fees totaling $220.00. The sellers agent, - - of Simply -, stated if we did n't sign that she had - other agents waiting for the house to fall out of escrow. We had no other choice, being under duress, but to pay the fees. Our agent reached out to the relocation company to get reimbursement and they refused. - then contacted title who stated - - should have paid the fees. In e-mails between North American Title and Allegiance Relo we found out that North American Title had changed the docs after we had signed them. The sellers were to pay the fees yet someone in title had crossed out seller and written buyer unbeknown to us! There are e-mails between - - at North American Title and - at - that were - to us. We have yet to get any documentation on our home warranty policy as well. Title left it out of the closing documents on the -. I contacted my agent - - on the - -, 2015 about the home warranty.
