I have an executed agreement to purchase a home owned by The Bank of New York Mellon through their agent, - - - -. Prior to closing, a roof repair was done ; however, the party who did the repairs failed to obtain a building permit or professionally complete the repairs. During the walk through it was evident that the roof was still leaking. A licensed roofing contractor provided me with an inspection and estimate to replace the roof since a repair is not permitted. The city building department confirmed that a complete roof replacement is required and has issued a stop work order posted on the property. The roof must be replaced by a licensed roofing contractor, it is now a code enforcement issue. The seller initially argued regarding who did repairs ( not material ) and insisted I close as is or cancel the contract. I could not obtain insurance with the leaking roof. The seller would only refund my $5000.00 escrow deposit and refused to pay my direct expenses over $1100.00. I received an email to call - -, after agreeing to replace the roof the seller now is refusing to do as they said they would do. I want to purchase the house and I want the roof to be replaced as they agreed to do. The seller keeps bringing up the sale was as is '' which I agree is correct ; however, hiding a leaking roof with new paint followed by having an unpermitted repair that left holes in the roof is deceptive at best. My agent is - - --, the managing broker of the - - - Florida - has taken over the transaction, - - ( - ) - -- : The seller hid a leaking roof with white paint, when they had repairs completed, their repairman failed to obtain permits, did not complete repairs in a workmanlike manner and it was still leaking.
