On - -, - Cavalry Portfolio Services LLC ( CPS ) filed a complaint against me. They served me on - -, - ( docket is attached ). I filed a Notice of Dispute requesting debt validation into the court record on - -, -. I never received debt validation. I filed my Motion to Dismiss on - -, - after requesting an extension of time to respond. The Plaintiff 's attorney filed paperwork into the court record without providing me any copies on - -, -. On - -, -, the Plaintiff filed an Account Settlement into the court record without my receiving or agreeing to it. A hearing was set for my Motion to Dismiss on - -, -. Prior to that I filed a Motion for Leave to Amend the Motion to Dismiss on - -, - because there was new information I found. At the hearing on - -, -, I informed the court that it had no jurisdiction over me because the complaint was filed - and I live in -. I also informed the court that the Plaintiff lacked standing because the Bill of Sale and Assignment of Loan attached to the complaint stated
granted my Motion to Dismiss, the Plaintiff would be unable to file a new lawsuit because it would be outside of the statute of limitations. Incredibly, the judge allowed the Plaintiff to be substituted on - -, -! It is not my fault that the Plaintiff lacked standing because the attorney named the wrong Plaintiff. Furthermore, the Plaintiffs have never validated any debt to me nor provided any assignment of a debt contrary to - Statute -. I timely filed my Objection to Substitute Plaintiff on - -, - and requested a hearing, which still has not been heard. My Amended Motion to Dismiss will be heard on - -, -. This debt collector has affected my reputation by having a complaint against me since - which was served in -. These debt collectors had no right to sue me when they never provided to me any debt validation including loan level documents, contracts, terms showing the interest changes, how the amounts were calculated, who the original creditor was, etc. The court is permitting this debt collector to change the party suing me almost five years after the lawsuit was filed. It is not my fault that this debt collector has faulty records and does not know what it is doing and who it should sue. I do n't understand how a Plaintiff can be substituted after more than four years in a lawsuit. The Plaintiff was conceding that they had no right to sue me as CPS and requested that the court allow them to continue to harass me by permitting the change of Plaintiff.
