I have submitted numerous requests to RS Clark for validation of the debt and have not received validation. This is a collection account for an apartment complex. I have never entered into a lease with this apartment complex and I have asked RS Clark to see a copy of the lease I allegedly signed. I had a firm retained to send out for validation of this debt and a cease and desist phone contact order. What they sent back as validation is concerning. It shows my daughter as the guarantor, yet she was - years old at the date of service on the invoice, a medical practice we have never heard of for a specialty my daughter has never required, in state we do not reside in, and a doctors name we have never heard of! ... |

RS Clark continues to believe they have properly validated this debt ; however, they have not. The FDCPA holds that " a computer generated form made to look like a billing statement from the original creditor in response to a debt validation request is NOT sufficient for debt validation. They had 30 days to respond. They did n't. In response to a prior complaint filed with CFPB, they provided an accounting stating that this validates the debt ( see attachment RS Clark - '' ). It does not meet the requirements under the law and does not validate the debt.
