In - -, my husband and I filed chapter- bankruptcy. We paid 96 % of the claims and were discharged successfully after 5 years. My Issue or complaint with ECMC is that 1 ) We just completed a chapter - bankruptcy where they filed a claim ( as did - -, more than once ), and we paid those obligations in full or close to, and 2 ) Now that we 're out of bankruptcy, they are claiming I owed significantly more than what was claimed, and those claims came to ECMC via - -, 3 ) we 've presented SEVERAL issues with the amounts they are claiming I still owe to them, my lawyer, and THEIR lawyer, and 4 ) the lawyers involved in the issue are allowing the issue to continue whereby I 'm being penalized for following everything I 've been told to do by my lawyer 's office. We believe we paid - - in full ( or close to ). I have issued a dispute with ECMC and filed a request for a hearing from ECMC, but I have not heard back from them. I have not tried to DISCHARGE any student loans - in fact, I 've done my due diligence to get them paid and avoid wage garnishment ( without obligating myself to loans I feel are erroneous ). However, even when following the advice of the lawyer 's office and attempting to follow the rules outlined to me, even with successfully completing the chapter - bankruptcy, I not only was harassed by ECMC with threatening phone calls/emails, they somehow were able to garnish my wages with no hearing, no follow-up to my dispute, and no formal notification from them other than the notice/request for a hearing documentation that I submitted to them within the timeframe allotted, and no response from their lawyer. Upon review of the account transactions from ECMC and the Chapter - Trustee 's ledger there were several concerns as follows : 1 ) ECMC has included charges totaling $12000.00 for collection costs. These charges were all assessed while in the Chapter - Bankruptcy case. 2 ) On - -, - ECMC shows transferred records totaling $45000.00. The Proof of Claim filed by ECMC on - -, - was only filed in the amount of $10000.00. We believe that the transferred records totaling $45000.00 were paid as separate claims in the Chapter - Bankruptcy in part or full. 3 ) - payments to ECMC were reported as unclaimed funds totaling $2000.00. A change of address was filed by ECMC on - -, - which appears to have resolved the issue of the unclaimed funds. 4 ) There was a payment by the Trustee on the claim of ECMC dated -/-/- in the amount of $140.00 that was not posted by ECMC in the transaction history and was not reported as unclaimed funds. 5 ) There was a payment posted in the transaction history dated -/-/- in the amount of $97.00. The - issued this payment on the claim of - - - Trustee 's claim number - not for the claim of ECMC.
