In - I financed a - - - - - from Credit Acceptance Corporation. On - -, - a district court judge in - -, -, through a civil court proceeding, awarded aforementioned - - to my ex fiance, - -. She was ( under civil contempt of court ) to refinance the vehicle, and assume any back payments. - - failed to do so. In - of - the vehicle was repossessed from her residence in -, -. Credit Acceptance Corp then attempted to sue me in - - - via a third party collections Law office ( - - - and -. ) I was living in the State of -, and had been for three years. This is a venue violation under the Fair Debt Collections Practices Act ( FDCPA ). I never received service of process. Rather, my father was served a summons for my appearance at his home residence, in -. He opened the correspondence. This is another FDCPA violation, as I never gave permission to account details to be disclosed to any third parties. I notified the firm ( - - - and - ) that I did not reside in -, and provided


disputed this account with the credit reporting bureau, -. The creditor then changed the account from charged off to repossessed, which caused my FICO score to go down over - points. This account is seriously hindering my abilities to acquire any lines of credit at this point, whatsoever. Credit Acceptance Corp then filed my account with the offices of - and - in - -, -. I contacted them to dispute the account, and advise them that I had moved back to - state, and had been here for several months I was told that they too had filed suit against me in - -, - ... a county I had not resided in for over a year. They advised me to forward them the papers from the court, showing that I had been released from my obligations with regard to the aforementioned vehicle. I fulfilled their request and was told that I would be contacted back within 5 days. I heard nothing. After several months, I contacted Credit Acceptance Corp, to inquire as to the status of my dispute. I was told by the representative that the account was being handled by their " in-house legal team '' and should be expecting another suit shortly, as they never received any paperwork regarding a dispute from - and -, and " did n't believe that I actually had any such paperwork. '' ( Again, I never received service of process, with regard to suit being filed against me. ) I have never been treated with anything other than rude, ignorant language by any Credit Acceptance Corporation representative, and have a suspicion that most of their csr 's work from home, as I 've had conversations in which I 've been able to hear other people discussing non business related topics, and have even heard children yelling and fussing in the background. I feel their business practices are completely unacceptable and incredibly unprofessional. I am not responsible for this debt, and am sick of being threatened with lawsuits by this company and their hired, - party thugs. I am attaching the documentation from - - district court to this complaint, proving that a judge released me from all obligations to this account. I would like this permanently removed from my -, -, and - credit reports, at very least, and feel that $1000.00 in damages per violation comitted under the Fair Debt collections Practices act is duly owed at this point in time.
