I never received my initial collection letter ( or any letter ever ) regarding this debt. therefore, I never was informed about my 30 day grace period to dispute the debt, to prevent this from incorrectly affecting my credit. For this to be on my credit, is a violation of the FCRA. That is my first issue. Next, I know the they have my contact phone number, because it has been the same since middle school, and I believe I received a call from the reporting agency in - -, but they did not say the Mini Miranda, and they did not try to confirm who I was, and that is a third party violation, according to the FDCPA. I did not feel comfortable on the call ( having a knowledge of the minimum requirements for a collection call ) so it was a short call.

We advised the on site manager that I was disputing the dollar amount that they are claiming that I owe. After discussing the issues a little, we learned that the Collection Agency is just a small local Agency. We then informed her that my father and myself are both in the Collection business and the call was being recorded, that 's where the call went South. The lady AFTER openly discussing, then claimed that she could n't discuss, and that the - is the OWNER of the account now, and was trying to hurry off the phone. Before she terminated the call on us, we reiterated and made it VERY clear that there have been violations here, according to both the FDCPA and FCRA, and that we understand that the apartments are not the reporting agency, but due to us advising her of this information and her doing nothing about it, that would make the complex office associated with this violation. And the lady Laughed at that comment as she was abruptly terminating the call on us. As the Original Creditor, they should be able to tell their reporting agency of an issue. Or at least advise them of my dispute. Re-checking my report this past week ( 3rd week in - - ) I see that it is still on there and it is NOT FLAGGED AS DISPUTE. I believe that is another Violation of the FCRA. To my knowledge it should state something along the lines of 'pending dispute. ' or just be removed during the investigation. While filling out this complaint, I thought to call the Reporting agency, Collection Services of Nevada just to double check, and talked to a man in the legal department, and asked if they are Debt Buyers, or just a third party agency. He said they do not purchase debt. I then asked him if they OWN ANY of the accounts that they report, and he confirmed the answer was NO. So, 1 ) I never got my final bill, no itemization as to why i would ever owe that much, and i do n't know what my initial move in deposit was applied to, or if it was even applied at all? 2 ) I never received my initial collection letter that has the 30 day Dispute disclosure ( FCRA violation ) 3 ) on -/-/- ( I have the recording ) I clearly advised the manager that I was DISPUTING this. My credit was last updated -/-/- and as of today -/-/- there is NO DISPUTE flag, which is another FCRA violation. 4 ) The manager i talked to gave me false information, and incorrect information and laughed and hung up on us.
