In -/-/- we received a notice from Navient that my wife 's student loans were past due. I am a cosigner on - of - loans. The loans were taken -/-/--/-/-. My wife has been in school half time since then, but has switched schools a couple of times and is still in school at - - - University. We requested the promissory note and it clearly states that as long as she is I school at least half time, they will put the loans into forbearance. We have pointed this out several times to their collections and Ombudsman ( who is in their collections department ) and they can only state they have a policy that all private student loans are to go into repayment after 48 months. Nobody looked at the agreement, not even the Ombudsman who told us he was instructed by his boss to tell people they just have to pay, no matter the circumstances or agreement, to get those people to pay. We requested their Customer Representative investigate, received a voicemail a month ago that they would, but have heard nothing since. We have been harassed by phone calls/emails/letters and Navient has put negative entries on our credit reports preventing us from buying a house. I requested multiple times the written 48-month policy and was told nothing is written. I 've also sent them a certified letter requesting documentation for which they have not responded. I sent a certified letter to forbid them from calling me as they were interfering with my work. The person who last called me read the promissory note I uploaded to their site and could find nothing supporting they could force repayment. He still stated they had told us numerous times we had to repay, so we needed to just pay. We have no intention to not repay the loan, but as per the promissory note we both agreed to, not be an undocumented policy that is in direct conflict with the note.
