My daughter and I have retained an attorney ( - - - ) to ( 1 ) attempt to negotiate a pre-litigation settlements of our debts and ( 2 ) litigate the matter if necessary. Navient, the the third party servicer for a yet to be identified student loan trust, is very aware of - - 's involvement in our affair and Navient has been advised he is our counsel. We are also aware Navient has spoken directly with - - and his staff. However, it is our understanding Navient is refusing to negotiate in good faith. MY DAUGHTER AND MY particular complaint herein is NAVIENT IS REFUSING TO DISCONTINUE DIRECT CONTACT WITH US because - - is not simply accepting they insistence we pay - % of the debt owed immediately. As a debt collector for the student loan trust, I belive NAVIENT IS VIOLATING THE FDCPA 's provisions that a debt collector must cease direct communications when they know or have reason to believe we are represented by counsel. They should not be allowed to ignore my attorney and/or not speak with him when they do not like what he is saying. Moreover, they fact he is simply not agreeing with him does not mean we are unrepresented. - - is our attorney until we complete litigation is necessary. Therefore, NAVIENT is knowingly and malicious disregarding the provision of federal collection law.
