I have a current open case with Gateway One Lending ( - ). I was sold a vehicle with a rolled back odometer. The dealership I purchased the vehicle from, - has an owner, - - had the odometer rolled back on the vehicle 14 days before I purchased it. At the time I signed for the vehicle, - - presented a juxtaposed carfax showing the vehicle had no issues. All of the documents including those that I still have show that I was a victim of dealer odometer fraud ( Federal Crime - Dod Frank Act ). I reached out to Gateway One immediately upon receiving this information that I 've been a victim of a fraud. Every call that I made to the institution, I would get forwarded to the collection deptartment. I asked them to please take time to hear my situation. I explained the disrepancy to the collections rep and asked if they can forward me to loss mitigation. They would tell me that they will put in the notes in my account my request, and that I have to pay $900.00 on my account immediately. After several attempts to reach out to someone that can
so and - or - collections cals telling me I need to pay $900.00, I get a call from - in loss mitigation. I explained the situation and that I took the vehicle to trade it in, the sales manager ran - to find the $19000.00 vehicle I am on the hook for is only valued at $5000.00. ( dealer provide all documents ). - told me in our initial conversation that It is not their responsibly to check VIN numbers and history on the vehicles they finance. He also said that it was my responsibility to check the title history on a car I buy to make sure the odometer has not been rolled back. He also said that if I do n't pay $900.00, that they will repossess my car. I asked him if they could restructure this loan, or give me my money back and take back the vehicle due to the fact that I am a fraud victim. I also asked him if he can help me by reporting to the credit bureaus that this account is in dispute. He said in the exact words, " We do n't do that '', and we are going to have to report your late payments to the credit bureas. He said that he will forward my information to another department that will investigate the situation and call me when it is complete. I asked him if he can send me this in writing or an email so i can be asure that they wo n't try to take my only car from me. He also said that Gateway One does not send written notices of an investigation their customer 's accounts but I receive numerous collection/repossession notices. After 2 weeks and several attempts to call julian, I never received a call back from anyone looking to help me. I would just receive collection calls telling me to pay $900.00. The final call from gateway One I received was not from - but from an individual in collections who lied and said he is an ivestigator whend hemail waso acu ally a collections agent posing as a fraud investigator. I informed him of his companies lack of consumer protection assistance. I told him that I needed help. I asked him why - didnt call and I have a fraud investigation ongoing. He said in the exact words, '' thats all over with ''. He said that he called the dealer and he didnt answer and you owe $900.00 or give him back the car. I told him that that is not a resonable solution for a fraud victim. He then began yelling at me and saying, " So you are refusing to pay for the car? Seemingly to try to coax me into saying im refusing to fullfill my obligation over his recorded line. He then started shouting very loudly athe me '' Were is our vehicle!, We 're is our vehicle!! ''
