Hyundai Capital America Consumer Loan department,
Vehicle loan Managing the loan or lease Kentucky
On - -, 2015 I wrote to Hyundai Finance at the addresses ( there are - different ones ) listed on my credit reports regarding an outstanding balance of $180.00 they were reporting. Their response dated - -, 2015 listed a vehicle purchased at - - in -, - Their letter, it should be noted, included no suggested method of payment and included the disclaimer that as an 'original creditor ' they are not subject to the FDCPA. I wrote back on - -, 2015 to explain that I had never purchased a vehicle at - - ( in fact had never been to -, PA - but that I was willing to pay the $180.00 to get this delinquent balance off my credit reports if they would provide an invoice or some other way to pay. That letter was ignored. I sent a subsequent letter, and received in response a bill of sale from - - - in -, PA NOT - - of -, PA. It should be noted, - and - are on opposite sides of Pennsylvania. It should also be noted that despite my pleas, there was nothing in the envelope but the bill of sale.
were also either responded to with a generic reply or ignored. It seemed I was left with no other option but to file a complaint with the - regarding this matter. I did so on - -, 2015. Subsequently, I was contacted by - - of Hyundai Capital. - -, however, would only agree to speak to me on the telephone, even citing a 'company policy ' to 'not communicate an ongoing conversation by email '. I responded to - - to explain that any verbal explanation over the phone, or any discussion of a settlement to this dispute, would need to be IN WRITING, so could he please advise if he is willing to put any documentation and/or promises in writing? I received no further response from him. Hyundai responded to my - complaint by suggesting I file a fraud complaint if I do not feel I actually purchased the vehicle in question. A follow-up to that complaint received the same response, either I could file a fraud complaint OR I could take this matter up with the CFPB. So here we are. I will NOT file a fraud complaint as having such notations in a credit bureau file can lead to adverse action on other positive accounts as well as can impair the ability to acquire new credit. There is no valid reason I should have to suffer further damage to my credit due to the inability of Hyundai Finance to resolve this matter. Additionally, I simply wanted an explanation of how this $180.00 balance was determined and a way to pay it if it is valid. There was no thought nor accusation of fraud until Hyundai Finance sent me a letter stating the vehicle in question was purchased at a dealer I had never been to in a city nowhere near my home. THEY are the ones with conflicting information, not ME.
