I had a car financed with Hyundai Motor Finance the past six years. I only had four payments left on the car when I was involved in an accident. As a result of my claim I was given a check for $1700.00 and by the time I got my check I only owed about $350.00. I decided not to get the car repaired because I ended up getting a different car. Because Hyundai still had a lien on the car the check from the insurance company was made out to myself and Hyundai. When Hyundai got the check they took out the - I owed them and said they would send me the balance of $1300.00. I asked when I could get the balance they owed me they said they were going to hang onto my check for 30 business days. Can they hold my money for 30 business days?
