Credit card Communication tactics Threatened to take legal action Ohio
Today I got a voicemail from a - - from - - -. She did not disclose that she was a debt collector. Just that she was calling about a legal matter that will require - to appear in court ''. She also did not disclose that any information collected would be used for the debt collection purpose. She used language to make it appear she was from a law firm. I 'm an arbitrator for the offices of - -. Never mentioned anything about a debt. Just that I 'll have to face court against the allegations against me. She then calls my husband who answered at work saying that if we do n't pay the $580.00 I owe by the end of business today that will sue for over $2000.00. According the Fair Debt Collection Act that a collections company may be allowed to charge interest on debts they are collecting. But they ca n't charge more than the amount described in the original contract or what is permitted by law. $2000.00 would go way beyond that. Also that debt collectors must follow the mini-Miranda '' warning '' on voice mails and she did n't follow any of it. There is nothing actually filed in court. They caused me a lot of stress saying I was going to have to appear in court for allegations '' when I had no idea what those allegations could be.
