I have had a dispute with - over this since 1994. I completed an " Application and Promissory Note '' for a Consolidation Loan from - - - -, because I was led to believe by a Collector that I might benefit from the program. When I received the Disclosure Statement, some five months later, it was clear that the higher interest rate and capitalization of the penalties was not to my benefit. Therefore, I did not accept the terms of this loan contract, nor sign any agreement, nor make any voluntary payments. Clearly, there was no " meeting of the minds between two parties '' as required by contract law. The loan subsequently defaulted and was guaranteed by USA Funds. It defaulted again and was then guaranteed by -. Since then, - has steadfastly refused to provide me with due process to resolve this issue. Their contract collectors have committed violations of the Fair Debt Collection Practices Act. Both - and their contractors continue to assert that this is an enforceable contract even though I never agreed to any specific terms. The simple question is this- do student loan agreements fall outside of the accepted principals of contract law?

I had rehabilitated my student loan in 1994 when, while checking my options, - - - - voluntarily satisfied my debt without my permission. When I refused to accept their fraud, USA Funds then filed a fraudulent default claim with -. - has been harassing me since 1994. - should be looking to recover the funds from - and/or USA Funds. The simple question I have is this- are student loan banks immune from the basic principles of contract law? How do I get this -?
