BankUnited Mortgage department,
Conventional fixed mortgage Loan modification, collection, foreclosure Virginia
We were told that we were turned down for a HARP modification to our mortgage - then given the option of appealing but the appeal was ignored, and the bank accelerated the process of setting a foreclosure date. The paperwork was processed on -/-/2015 - foreclosure date was set for -. We then tried to negotiate a reinstatement - we offered 50 % of the past due amount plus past due/legal costs and 50 % amortized over 12 months. This was accepted, we liquidated our insurance policy to obtain the funds, we informed the bank the check would arrive Monday - - and to send reinstate docs plus exact amount due. The bank agent did not respond until later in the afternoon at which time they told us that we could not due the deal agreed to but rather we had to contact the foreclosure attorney and pay the full amount plus new fees and charges. We wrote back to the bank after contacting the foreclosure attorney who said he could not negotiate anything other than the full amount. The bank has ignored our email contact and calls. The attorney said he has to request the reinstatement amount that was nearly two days ago - it will cost another $ - but for now we have no feedback and foreclosure sale is set for a week from Thursday. We feel the bank has not acted in good faith and in fact appears to have made commitments it never intended to keep.
