I received an employment offer from - - cable in - - on -/-/2016 pending a consumer background report investigation which was subsequently performed by General Information Services ( GIS ) based out of -, -. I then received an adverse action letter from GIS followed by an email from - - informing me the offer had been rescinded due to criminal conviction information reported by GIS. GIS reported criminal convictions to - - that antedated or preceded the report by more than 7 years which is a violation of - Law, specifically - Business and Commerce Code Chapter 20.05 which states : Sec. 20.05. REPORTING OF INFORMATION PROHIBITED. ( a ) Except as provided by Subsection ( b ), a consumer reporting agency may not furnish a consumer report containing information related to : ( 4 ) a record of arrest, indictment, or conviction of a crime in which the date of disposition, release, or parole predates the consumer report by more than seven years ; ( b ) A consumer reporting agency may furnish a consumer report that contains information described by Subsection ( a ) if the information is provided in connection with : ( 1 )
employment of a consumer at an annual salary that is or may reasonably be expected to be $75000.00 or more. ( b-1 ) A consumer reporting agency may furnish to a person a consumer report that contains information described by Subsection ( a ) if the information is needed by the person to avoid a violation of 18 U.S.C. Section 1033. The salary offered to me for this position as a Call Center Customer Retention Rep was $13.00 per hour or $28000.00 annually. I want to file a compliant that my FCRA rights were violated by GIS by the reporting of criminal convictions to - - cable that were in fact, older than 7 years, which directly led to my employment offer being rescinded, and caused harm to me.
