My partner and I are the beneficiary of an estate and have inherited a home in FL. The property was fully paid for ( No first mortgage ). The owner had a Home Equity Line Of Credit available which has never been utilized in any way and has a ZERO balance due. The Decedent went to great lengths to create an estate that would not require any probate actions upon his death. He had - outstanding debt and lived a simple life. Upon his death my partner and I as joint tenants on the deed took ownership of the home. In order to improve the property to lease it we have been approved for a first mortgage by - -. Chase bank is holding a lien for the HELOC and is refusing to close the line of credit WITH A ZERO BALANCE without a court authorized agent signing a bank required document to close the account. The cost of probate to appoint a court authorized agent will cost - to - - dollars in attorney fees to have a line of credit closed. I have already spent $330.00 for an attorney to send a letter explaining the UNREASONABLE BURDEN this arbitrary requirement CHASE bank is imposing on us.
