A hold was placed on my checking account this afternoon for $5100.00. I contacted my bank, -, and they named Premier Credit of - - and Indiana Department of Revenue as the parties requesting the hold. I had not heard of Premier Credit of - - before, and because I pay taxes I 'm familiar with -. However, I was shocked to learn that there is a claim for that amount of money, and even more shocked to have found out by not being able to access the funds in my bank account. I did not receive a certified letter, a notice to appear in court, a day in court, nor was I served papers, or anything similar that could prove that I was provided with communication regarding whatever is going on. According to -, they received a court order and have to comply - my question is where is MY copy of said order? Why do n't I have the order? How is it legal that a - is afforded due process, but I 'm not? I 've been paying taxes since I was - years old, and my income continues to rise, which means the amount that I contribute to this state continues to increase - along with my property taxes. I am extremely offended by this miscarriage of justice. Why is it legal to take money from a bank account without advising the account holder in advance ( certified notification )? Furthermore, this money is not owed, which I will have to spend my time, taking away from my husband and - young children, during the next several days/weeks/months resolving whatever this is all about. However, my issue right now is not whether I owe a debt for $0.00 or a - dollars - the issue is how is the practice of seizing bank accounts over an " assumed '' debt without providing prior notification or even dispute resolution legal? Where is my due process? Where is my day in court?
