Identity theft / Fraud / Embezzlement New Jersey
American Express has a credit card issued under my SSN with a $22000.00 limit. It appears in my credit report. I had never applied for this account and its a fraud account. The name/address/dob on the account does not match mine. I have sent Amex a notarized affidavit of Identity, a copy of SSN card, Driver 's License, FTC report, Receipt of police case and an affidavit stating that I have no - - checking/saving account which they claim I have used to pay for this fraud Amex Credit Card Account. I have raised this issue FIVE times and every time they say " Thank you for bringing to our attention the dispute regarding the account referenced above. We have reviewed our records and are unable to accept your claims since you made the payments. Therefore you have accepted liability for the account. Our investigation has revealed that payments have been made from your - - Account Bank ''. I have five such letters with me.
They sent me the transactions on this account for last 2 years and its very obvious that the account belongs to someone in AZ who had used it in the past to buy airlines tickets also ( names of the passengers are in the transactions ) They have refused to close the account, even though I have requested this FIVE times. They have refused to send me the - documents unless I attest that my name is the one which appears on their records ( wrong name-wrong person- they are using my SSN ). This has been going on for 1 year now. So if the person who has this fraud account under my SSN decides to buy something for $22000.00 and not pay back - Amex will hold me responsible. They want me to get a notarized letter from - - that I have not paid for this account. I can not get such a document as the - - Branch Manager says that they can only give a letter for the accounts I have, but not a letter stating that I do not have any accounts. The customer service from Amex has not been helpful at all and they refuse to even do a reasonable investigation or send the documents they have used in reaching their conclusions. Its almost like Amex is holding me hostage to Identity fraud and waiting for the fraud account holder to commit a fraud and then go after me for collection. I am extremely frustrated with Amex and their harassment.
