I was issued a - credit card that was serviced by CapitalOne. On - -, 2016, I received an email stating that my autopay, monthly payment drafted directly out of my checking account, was canceled and that I would need to make payment using other methods henceforth. I was out of the country and could not respond. I have been informed that CapitalOne sold my account to another creditor because I had filed for bankruptcy. I was not delinquent on any payments. The checking account that I used for my autopay had enough to cover the - payment. Also, I never received a demand letter for the alleged outstanding balance. I could have paid it and wanted to pay the balance that I owed them. I did not include that in my bankruptcy filing. I stipulate that CapitalOne has the right to rescind credit extended to a customer. However, it does not have the right to refuse payment and then take action to collect the alleged balance owed. Also, bankruptcy law places an 30 day stay on any collection activity. The bankruptcy was filed on - -, 2016.
