In - I obtained - student loans ( private ) from - and -. The servicer at the time was - which later became Navient. It was at this time that our daughter developed a - -. The medical bills began to soar out of control. At the poor advise of our attorney we surrendered our home and filed a chap - bankruptcy that would include all of our student loans. Incuding our student loans meant that they would be paid while the chap - ran it s course. We filed and the program required us to pay 57 % of all our unsecured debt which was our student loans. After approx 4 1/2 years we completed the chap -. When we reviewed the court trustees documents, we found that we had paid approx $16000.00 to Navient on a $21000.00 loan. When we completed the program we needed to know where we stood with our loans so we could calculate our repayments options. We contacted Navient and requested an audit which they did not due. They instead dictated their terms of repayment to us. It was this time we discovered that according to Navient we owed $21000.00 not the $6000.00
Capitalization, Post Petition Interest, and the & year rule that the outcome. I calculated the repayment that Navient stated we should pay. The monthly is approx $110.00 for 10 years prior to our Chap -, and thats what it is for the next 5 years. At this rate we could NEVER repay this loan, NEVER! It is inconceivable that a company that uses the US Government as leverage against normal citizens, ( veterans, Which I am ) to line their pockets. We paid $16000.00 on a $21000.00 loan Thats 76 % of that loan, and they say its not enough. I understand that Navient is being sued by - states attorney generals, and the Dept of Education 's OIG for deceptive practices, and misdirection of repayment that would benefit them. I need some real help with these guys.
