From - of - to - - I lived in the income restricted property, - - - in -, FL. One of the lease addenda stated that if my family size or income changed, I was to report it immediately, and if the income exceeded the allowance, I was to move out within 30 days or by the end of the lease, whichever was sooner. I married, my family income rose, exceeding the allowance, I paid my prorated rent and submitted the 30 day notice, but the manager refused and returned my check and told me I was going to be liable for the remainder of the lease. I continued to proceed with moving out, and when management filed for eviction, I responded and requested an amount to pay into the court registry. However, their unethical lawyer claimed I never replied to him ( he actually never picked up the response I sent via certified mail, which was eventually returned to me. He motioned the court for a default judgment without notifying me, and when I called the court to find out when the hearing was, they told me that the judge had already issued a default. I subsequently filed


prorated amount I attempted to give the manager. I actually mailed the check prior to receiving the signed copy of the court order, and still have the certified mail receipt indicating that it was received. Nevertheless, the management company had reported a debt of $1500.00 to each of the - credit bureaus which they have not only never removed despite my disputes, but most recently reported to - last month. Apparently the collection agency and/or management company is still misrepresenting this, and the credit bureaus are taking their word for it that I owe them this money. They list the account as " opened '' on - -, -, which was 3 months after I moved out of the apartment and two weeks AFTER the court vacated the default judgment. What do I need to do to get this fraudulent report off of my record? Can I sue them for this? Can they be fined? This is n't an oversight ; it is intentional. I am attaching the following documentation : the original Order of Court 's Default ( -/-/- ), Order Vacating Final Judgment ( -/-/- ), Notice of Hearing ( -/-/- ), Order on Defendant 's Motion to Vacate Default Final Judgment ( -/-/- ), the stub from the money order I used for payment ( -/-/- ), and the US Postal Service Return Receipt for the rent ordered by the court, signed by - - 's manager on - - ( the hearing was on - - ; I mailed it the next day ). I want this removed from all - credit bureaus. Your assistance will be appreciated.
